Carlos Linares, presidente de la Asociación Gremial de Organismo Técnicos de Capacitación de Chile (Agmo), reflexiona sobre los alcances y el impacto de la nueva ley de modernización del Sence que impulsa el gobierno de Sebastián Piñera, y que deberá ser votada muy pronto por los parlamentarios.
Asegura tener sentimientos encontrados. Por un lado, dice estar muy consciente de que Chile despertó y ve con optimismo lo que se puede hacer para poner al Sence, de una vez por todas, mirando el siglo XXI.
Sin embargo, muestra decepción y preocupación por las formas y el fondo de cómo el ministerio del Trabajo está llevando el proceso. «Veo diagnósticos pobres, superficiales. Por ejemplo, acá no vemos nada respecto a la incorporación en la formación de las nuevas tecnologías nacidas en la revolución 4.0. También, muchas veces, hemos enfrentado fake news y sentido la arrogancia, la soberbia y el menosprecio, al no ser consultados, no sólo hacia nosotros si no que a casi todos los actores relevantes de la industria de la capacitación», enfatiza.
Tiene la convicción y la esperanza que en sala los parlamentarios velarán por las y los trabajadores más desprotegidos y se podrán en el lado correcto de la historia: «rechazando una mala ley que le hace daño a la fuerza laboral con sueldos más bajos».
Afirma que nuestro país se merece un sistema de capacitación a la altura del siglo XXI y que mire lo que la ciudadanía plantea en las calles, más oportunidades y dignidad. Piensa que el proyecto diseñado bajo la actual administración de Piñera tiene una pésima implementación y un origen opaco. Reflexiona respecto a que no están los tiempos para «darse un gustito y cambiar el sistema de capacitación con los índices de deslegitimidad del gobierno y parlamento; además tampoco están las condiciones económicas para generar este cambio tan negativo para la industria de capacitación».
Asegura que el 18 de octubre es una tremenda oportunidad para que la industria de la capacitación en unidad pueda diseñar su futuro. «El proyecto del gobierno se hizo entre cuatro paredes y sin consultar a nadie. Al rechazar, un proyecto malo y poco representativo, los parlamentarios nos dan la oportunidad de escuchar a todos y hacer participar a los actores más relevantes, los trabajadores y trabajadoras. Linares afirma que la iniciativa del ejecutivo considera encarecer en un 20% la capacitación imponiendo un copago. » Este copago genera una traba en el acceso para que los trabajadores de bajos salarios puedan acceder a la capacitación. Por lo que lo consideramos una muy mala medida, ya que la capacitación busca incluir y con esto, se está excluyendo a miles de personas».
A juicio del presidente de Agmo pareciera que las autoridades no están entendiendo, o no están viendo, el momento que vive Chile. «La ley, de aprobarse, contraviene todos los sentidos comunes y sólo beneficia a los que más sueldo ganan y perjudica a las Pymes y los que menos tienen. Por ejemplo, un curso de alfabetización digital de 40 horas, que para la actual ley es gratuito, cuesta alrededor 200 mil pesos. Un trabajador que gana 380 mil pesos, con la nueva ley se deberá pagar 40 mil, es decir el 11% de su sueldo. ¿Dónde está dignidad? ¿Dónde la justicia social? ¿Estarán las empresas dispuestas a invertir un 11% de un sueldo en una capacitación?»
También denuncia el impacto que tendrá en las Pymes, en su caja y liquidez, clave para la continuidad y competitividad de este sector. «Hoy los excedentes de franquicia Sence no utilizada en un año tributario están disponibles al año siguiente. De aprobarse, las Pymes no tendrán liquidez, caja, para financiar la capacitación de sus trabajadores, ya que la ley de Sebastián Piñera quita ese beneficio. Tendrán que esperar 17 meses para hacerla efectiva».
El presidente del gremio de los Otec, enfatiza, que la ley abusa de los chicos y le carga toda la responsabilidad de la empleabilidad a estos organismos técnicos. «También rechazamos la intermediación laboral, ya que esta debe ser realizada por organismos externos y no por los Otec, principalmente porque no cuentan con el expertise en esta materia, lo que dificultaría el cumplimiento este nuevo requerimiento».
Insiste que la esta ley beneficia a los actores más grandes del sistema y a la elite con mejores sueldos. «Es fundamental volver a mirar y analizar los tramos de franquicia tributaria para dejar uno solo, eliminando el tercer tramo que incluye en este sistema a los sueldos más altos de las empresas, contribuyendo a alcanzar una mayor igualdad, eje central en las demandas para un Chile más justo».
Finalmente, asevera, que este «proyecto de ley tan mal concebido» dejará a 600 mil trabajadores sin capacitación y 16 mil puestos de trabajo se perderán en la industria de la capacitación.
“No solo 600 mil trabajadores perderán la oportunidad de acceder a capacitaciones que permiten entre otras cosas la movilidad social, que mejora rotundamente su calidad de vida y la de sus familias, sino que además 16 mil personas perderán sus empleos, provenientes de OTEC Pymes como programadores, diseñadores instruccionales, ejecutivos de ventas, etc., y eso es ir por la dirección contraria, que es un Chile con trabajadores mejor capacitados, con mejores oportunidades laborales y mayor igualdad”, recalca.
